Acceptance of terms

By downloading, installing, or using the SIPMILE mobile application (“App”) or visiting our website (“Website”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use SIPMILE.

Eligibility

You must be at least 13 years old to use SIPMILE. By using the service, you represent that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or guardian.

Description of service

SIPMILE is a running app that provides run tracking, personalised running plans, coffee-run routing (a feature where users can run to a nearby café as a destination), streak and progress tracking, and related features. The specific features available to you may depend on your subscription plan.

Health and fitness disclaimer

SIPMILE is a fitness and wellness tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any new exercise programme. You use SIPMILE at your own risk, and you are responsible for ensuring that any physical activity you undertake is appropriate for your health and fitness level.

SIPMILE is not liable for any injuries, health issues, or other harm resulting from your use of the app or its suggestions.

Account responsibilities

You may need to create an account to use certain features of SIPMILE. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at support@sipmile.com if you suspect unauthorised use of your account.

Subscriptions and billing

SIPMILE may offer subscription plans that unlock additional features. Subscriptions are billed through Apple's App Store and are subject to Apple's terms and refund policies.

  • Subscription payments are charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your Apple ID account settings.
  • Free trial periods, if offered, will convert to a paid subscription unless cancelled before the trial ends.

Intellectual property

All content, features, functionality, branding, and design of SIPMILE — including but not limited to text, graphics, logos, icons, images, audio, software, and code — are the property of SIPMILE and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the app or website, and you may not reverse engineer or attempt to extract the source code, except where permitted by law.

User conduct

You agree not to:

  • Use SIPMILE for any unlawful purpose
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Interfere with or disrupt the app or its servers
  • Scrape, data mine, or extract data from SIPMILE by automated means
  • Reverse engineer, decompile, or disassemble any part of the software
  • Use the service in any way that could damage, disable, or impair it
  • Impersonate any person or entity

Service availability

We aim to keep SIPMILE available and functioning reliably, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features or the service at any time, with or without notice. We are not liable for any loss resulting from such changes.

Termination

We may suspend or terminate your access to SIPMILE at any time if we believe you have violated these Terms or engaged in conduct that is harmful to the service or other users. You may also delete your account at any time through the app settings or by contacting us.

Disclaimer of warranties

SIPMILE is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements or expectations.

Limitation of liability

To the fullest extent permitted by law, SIPMILE and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profit, arising from your use of the service.

Our total liability for any claim arising from or relating to these Terms or the service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Governing law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict-of-law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “last updated” date. Your continued use of SIPMILE after changes are posted constitutes acceptance of the updated Terms.
